In addition to his expertise in construction contracts and their
administration, Iain has extensive experience in forensic analysis of construction projects
including profit and loss predictions and determination of responsibility for programme and
cost overruns. He also has considerable expertise in the preparation, analysis and costing of
construction claims, particularly those involving delay and disruption. He is a highly
experienced negotiator and a qualified Mediator and Adjudicator. Amongst others he has
carried out mediations at the London County Court and in a tripartite dispute between
contractor, subcontractor and a Government Agency and is a named adjudicator in a number of
contracts.
Over the years Iain has successfully prepared and negotiated claims and defence of
claims on behalf of his clients. He is an internationally recognised expert in construction
matters and has testified in and given expert evidence in arbitrations in Amsterdam,
Bahrain, Geneva, Paris, Rome and Washington as well as in the United Kingdom. He has also
testified as an expert in the Queens Bench Division - Official Referees Court.
Iain is included on the approved list of adjudicators for the Official Referees
Solicitors Association (ORSA) and has successfully completed an adjudicators training
course at the Institute of Civil Engineers.
Prior to the establishment of G T Fairway, Iain was a partner in
Gardiner & Theobald International. He spent a number of years in the Middle East as an
in-house consultant to one of Europe’s leading contractors working on some of the largest
building and civil engineering projects in the world as commercial and sub-contractor
manager. Iain reported directly to the Board and was responsible for all commercial
matters relating to the contracts. That responsibility included; pre tender analysis of
contract risk; contract administration; placing, administration and control of all
sub-contracts, including the drafting of standard forms; claims and quantity surveying
matters. Located in the contractors head office he was responsible for his staff of up to
forty surveyors and cost engineers and the commercial success of a portfolio of projects
with an aggregate value in excess of £4.8BN.
Iain has advised major international contractors on the development of claims strategy
and lectures to professional organisations, lawyers, construction companies on construction
claims matters, including claims avoidance techniques and disputes settlement. Iain has
also written a number of articles on construction matters for the Estates Gazette,
Construction Law Journal, International Construction and Contract Journal.
